Title Guaranty. In many countries, when you are on the process of investing in real estate, the Title of Ownership of the land is fundamental. In Costa Rica the National Registry is where every property is recorded and the need of a physical Title of Ownership is non existent. For anyone to know who the owner of certain property is, the National Registry will certify it at any moment. Real Estate ownership it’s set to be a public record.

However, the Registry doesn’t give you any guaranty that the transmission chain of particular property has been done without any defect or error, which presence could jeopardize the right acquired on the land and could even make you loose your investment completely.

That’s why Title Guaranty is highly recommended for any investor who wants to feel the security and reliability that it will give them, especially if it’s issued by a company that is internationally known, respected and recognized as reliable.

The benefits of the Title Guaranty are strictly related to the prevention of loosing the property due to defects on the transmission chain and are not extended to construction or land-structure problems. It also becomes a very useful tool for the owner to facilitate future credit with financial institutions over that land, and also in case the owner decides to sell the property in the future, the Title Guaranty will give the purchaser these same assurances.

In case of a legal problem regarding the title, the company that issued the guaranty will usually compensate the owner the value of the property or the legal costs of a proper representation in Court. Usually the cost of the Title Guaranty is 0,5% of the property value and it is paid only once.
